Dear Sir or Madam, Article 300 of the Act on Spatial Planning (Official Gazette of the Republic of Slovenia, No 61/17), hereinafter referred to as ZUREP-2, states that the Minister will issue certain regulations within 9 months after the entry into force of this Act (i.e. by 17 August 2018). Some of these, e.g. the regulation on the study of the economics (Article 65 of the ZUREP-2), are mandatory expert basis for the preparation of spatial implementation acts (OPN and OPPN). Please clarify whether and how the municipality can carry out the OPN or OPPN procedure despite the fact that the by-laws have not yet been issued (e.g. in the case of the study of the economics, it can prepare the expert basis as it sees fit, or it can not do so at all)? Otherwise, the Minister for the Environment and Spatial Planning is holding back the spatial development of the whole of Slovenia. Thank you for your reply and best regards!
