Hello. The amount of child benefit is determined by the total amount of resources distributed per family member. For foreign nationals, the basic condition for residing in the Republic of Slovenia or for obtaining a residence permit and, consequently, for registering their residence is sufficient resources for subsistence, which currently amounts to €260 per month per person. If the foreigner does not have sufficient means of subsistence, the law provides for the possibility to obtain the missing amount on the basis of a maintenance agreement with a third party, in the form of a notarial deed enforceable by a court, which is often the case in practice. Since the social work centres cannot obtain this information without the cooperation of the administrative units or notaries, there is massive abuse (if the centre does not verify the existence of the document and the foreigner does not indicate the funds in the application). In practice, cooperation between the authorities has proved inconsistent and insufficient, and child benefit is also taken into account as a means of subsistence when issuing a residence permit, which means that a family may have sufficient means of subsistence even if a maintenance agreement was not previously taken into account and is consequently no longer needed. I propose that a register of maintenance agreements with personal details, amounts and cancellations be set up, to which notaries would be obliged to submit information and to which the social work centres would have direct electronic access. If easier to implement, the data could also be established via the tax system or by any other means, by obtaining up-to-date and easily accessible data from the competent services.
