Dear Sir or Madam, I am engaged in the business of assisting foreign entities to set up companies in Slovenia; these entities need a tax number in order to be registered in the court register. However, the incredibly bureaucratic apparatus of the FURS is completely inflexible, as they constantly demand original powers of attorney for representation (which delays the process indescribably, as obtaining original powers of attorney often takes a week or more, depending on the delivery times of the post office). They require original powers of attorney despite the fact that the Constitutional Court of the Republic of Slovenia has long ago taken the view that the legal position that a power of attorney presented in a photocopy is not valid is completely wrong (cf. decision Up-858/09) - indeed, in relation to the ZPP, but the ZUP and the ZDAVP-2 contain essentially the same provisions on the power of attorney. I propose that the FURS be ordered to accept copies of the power of attorney and also to allow electronic filing of applications for entry in the tax register. Thank you.
