Dear Sir or Madam! We propose an amendment to the ZDR-1 concerning the control of sick leave in conjunction with the last indent of Article 110 of the ZDR-1. Currently, employers do not have a legal basis to carry out their own monitoring of sick leave in order to detect abuse of sick leave. Even if it is established by a random visit or by the testimony of others that there is abuse, this cannot be used in the termination procedure. Only the hiring of a detective, at the detective rate, is valid, and even then only to a limited extent, without photographing or filming, if the property is someone else's property. This means that Article 110(8) (last) is impossible to implement, or, indeed, it is questionable how expensive and time-consuming the procedures would be. Best regards
