Dear Sir or Madam! We propose to amend or supplement Articles 213 and 214 of the ZDR-1 concerning economic dependants. Even if the company does not condition some exclusivity or competition clause on the s.p. (sole employee) with whom it has a business cooperation agreement, under the current provision it is at risk of showing economic dependence if the s.p. has been less successful or has not even bothered to sell its services elsewhere. We suggest that the provisions be amended so that this can also be the subject of a mutual agreement between the two parties, so that they agree on what the client is responsible for and what the client is not responsible for. Of course, bearing in mind that there should be no elements of an employment relationship in their business relationship that would suggest abuse of the sole proprietorship status of the individual rather than the conclusion of an employment contract. The latter was probably the main reason for the introduction of the economic dependence provisions in the ZDR-1.
