Dear Sir or Madam,We are obtaining project conditions for the investor, among others, from the Institute for the Protection of Cultural Heritage of Slovenia, Maribor Regional Unit (hereinafter referred to as the Institute). Since November 2014 until today we have submitted 23 electronic applications (sent by e-mail to the e-mail address of the Institute's secretariat) and have obtained project conditions or consents for all but one of them. However, in the case of the last application sent, the Institute suddenly requested that applications for project conditions and consents can only be submitted in writing (analogically). In this regard, the Institute refers to Article 63 of the General Administrative Procedure Act, but only to part of it, namely: \"The application may be submitted in writing. A written application is an application that is written or printed and signed by hand (an application in physical form), ...\" At this point, the article in the law continues: \"... or an application that is in electronic form and is signed with a secure electronic signature with a qualified certificate.\" The Institute argues that the unlawful reference to the above article is due to the fact that it does not yet have an electronic commerce system in place, and that in the future digital applications will not be accepted. We would like to point out that the lack of an e-commerce system is not our problem and that the Institute is causing economic damage by making such unlawful demands. Our applications are very voluminous: they include correspondence and technical documentation (A4 cardboard folder, with a minimum of 10 A4 pages and a minimum of 1 graphical representation of A3 or larger). This is a considerable cost and time expense if the documentation has to be copied, reprinted and sent by registered mail approx. 10 times a day. For all other conditional and consenting notifiers, who are also public authorities and with whom we also deal EXCLUSIVELY electronically, we have not had such problems or experienced such requests.
