We propose to amend Article 54 of the ZDR-1 to provide that the reason for concluding a fixed-term contract or an annex to an existing fixed-term contract should be the use of the remaining (already worked) hours for credit or, at the employee's request, also for overtime hours worked. In practice, this is often a mutual interest, for which there is no legal basis, i.e. the conclusion of a new fixed-term contract when the worker would actually be absent from work. In order to receive the benefits from the Employment and Social Security Insurance Scheme, the worker is only a few days short, and the employer is unable to extend the employment relationship, but instead pays overtime. Both parties are then worse off - the worker is not entitled to benefits from the institution, and the employer costs more in overtime than in hours worked.
