As a real estate agency, I broker property sales. I have a brokerage contract so that if the client changes his mind about a long term activity with me, he also pays the brokerage costs. In this particular case, I charged her a partial commission of 1/4, or costs, because she walked away from the deal. These costs were written down at EUR 600. Because of such a "mistake", according to the inspectorate, I was fined 12,500 euros as a legal person and 1,000 euros as a responsible person + court fees close to 2,000 euros. I have to close the company because of such a decision by the inspectorate. I ask the competent authorities to declare the articles in the Real Estate Law that are unconstitutional unconstitutional and to repeal them and, furthermore, the unlawful decision of the Inspectorate. I have to say that cases have also gone through the High Court and the Public Prosecutor's Office, and apparently no one thought that the cases were abnormal. Further to the point - MJU note: The responsible person of the business entity has subsequently provided the MJU with documents showing that her specific case is pending before the Supreme Court of the Republic of Slovenia. In this respect, we would like to point out (which also follows from point 6 of the Terms of Use of the Poslovnisos.gov.si website) that the Business and Social Policy Coordinator does not, in the course of his/her work, interfere in the supervision of work carried out by other bodies, does not constitute an appellate body (he/she does not have the power to modify or abolish administrative acts), and cannot impose criminal penalties or annul administrative acts. The BusinessSOS project is not intended to influence the substantive decisions of the authorities as such, for which the parties have appropriate legal remedies.Nevertheless, otherwise lawful content (after having received the competent authority's position) may be perceived as a bureaucratic obstacle and a basis for a proposal to amend the legislation.
