Following the entry into force of the amendment to the ZGO on 28.07.2012, the question of the consents to be attached to the application, where provided for by law or regulation, remained open. Therefore, the provision of Article 66(2) of the Act on General Administrative Procedure (Official Gazette of the Republic of Slovenia No. 24/06, 105/06 - ZUS-1, 126/07, 65/08 and 8/10), which stipulates that the application must also contain other components provided for by law or other regulation, should also be amended. For example, the Regulation on the burden of soil with waste (Official Journal of the RS No 34/08 and 61/11), which provides in Article 9(4) that an application for an environmental permit must be accompanied, inter alia, by a water consent. Therefore, I propose that the aforementioned provision of the ZUP be amended to read: The application must also contain other components provided for by law or other regulation, except in cases where the components constitute consents that have been obtained by acquiescence of the authority. Also, the Water Consents PGI is inconsistent with the Water Act as regards the possibilities to refuse to grant a consent after the expiry of a certain time limit.
