An amendment to the Integrity and Prevention of Corruption Act (ZIntPK-C), which entered into force on 17 November 2020, was published in the Official Gazette of the Republic of Slovenia (Official Gazette of the RS, No 158/2020), introducing yet another bureaucratic nonsense. The responsible person of a business entity that deals with taxpayers on the basis of regulations governing public procurement or in the process of awarding a concession or in another form of public-private partnership must make a written declaration that the natural person or the business entity is not related to the public official and, to the best of his/her knowledge, is not related to a member of the public official's family as a manager, member of the management board, legal representative, directly or through other legal persons, in more than a five per cent share in the founder's rights, management or capital. Such a written declaration must be completed and submitted by all tenderers for each contract, including the smallest contract awarded by the contracting authority. This has added to the already bureaucratic administrative burden. Contracting authorities are therefore required to obtain this declaration from all tenderers and, for contracts above €10,000, an anti-corruption declaration and a declaration of ownership. I would remind you that we live in a digital age, when all this data is stored in computer databases (AJPES, FURS, ERAR, STATIST, KPK, etc.) and I expect the state to link the databases and find the perpetrators of offences or corrupt acts and punish them accordingly, rather than burdening thousands of honest bidders and conscientious contracting authorities with additional paperwork!
