As regards the conduct of proceedings in cases where vehicles are registered abroad, the Ljubljana City Police explains that in order to conduct proceedings, it is necessary to obtain information on the ownership of the vehicle (the latter, of course, only applies in cases where the offender is not present at the scene of the offence; if the driver is present, he or she will be issued with a payment order at the scene of the offence). Vehicle ownership data is required by Directive (EU) 2015/413 of the European Parliament and of the Council of 11. On 11 March 2015, the European Parliament and the Council adopted Directive (EC) No 4245 of 11 March 2015 on facilitating the cross-border exchange of information on road safety related traffic offences can only be obtained for more serious traffic offences (speeding; failure to wear a seat belt; driving through a red light; drink-driving; driving under the influence of drugs; driving without a safety helmet; use of a prohibited lane; illegal use of a mobile phone or other communication device while driving).The Commission can also provide information on the ownership of the vehicle. These data are automatically retrieved by querying the CBE/EUCARIS database. In the case of traffic offences relating to incorrect parking, no data may be retrieved. If the offender fails to pay the fine on the basis of the Offence Notice, the proceedings shall be discontinued in these cases without the issue of a payment order. They also explain that the Slovenian legal order in the field of offences does not provide for the involvement of various private companies to collect unpaid fines. Provided that the legal conditions are met, even vehicles with foreign registration plates are subject to a removal order. The City Administration, Ljubljana City Police, Department for Misdemeanour Procedure, does not keep any specific records relating to the payment of fines by foreign nationals (this also includes forced recovery). I propose to amend the sectoral legislation governing the area in question so that the newly adopted amendment to the existing legislation allows for the keeping of such records.
