Penalty points are a major violation of human rights, as they can result in the temporary loss of the right to drive a vehicle, or even of a profession. For this reason, it should be established for certain who was driving the vehicle at the time the offence was committed. However, this can only be when the driver is stopped. It is true that everyone has the right to prove that they were not driving their own vehicle, but that is not right. If it is already presumed that the owner is driving his own vehicle, the most that could be imposed is a fine, not penalty points. Only if the penalty points are definitely imposed on the driver concerned do they achieve their purpose. The current system of penalty points is unfair and harmful, and has even led to people being able to make money out of them by buying them from offenders.
