I propose to amend Article 31 of the Medical Licensing (Withdrawal of Licence) Regulations by adding a new condition for the withdrawal of a medical licence - for perjury by a doctor where it later turns out that the patient's state of health is not what the medical opinion stated. The measure would be progressive - the first violation would be followed by a revocation of the licence for a period of e.g. 2 years, the second violation for e.g. 5 years, the third violation would be followed by a permanent revocation of the licence. Reasoning: The proposal is aimed at patching up a loophole in the law which in some cases has led to the successful avoidance of trial or imprisonment (e.g. in the cases of Zidar and BavĨar, where after the successful interruption of the trial/imprisonment it turned out that the patient's health was not really at risk and therefore there was perjury on the part of the doctors).
