I propose that the Government of the Republic of Slovenia amend the legislation accordingly to prevent the repayment of bank execution costs from social assistance. Under the current regime, banks are allowed to deduct bank enforcement costs from the one-off cash social assistance. However, since the one-off cash social assistance is thus spent unjustifiably, the recipient of this assistance is not allowed to apply for a second grant for a period of 14 months. The recipient of the exceptional cash social assistance is obliged to use the assistance received for the purpose for which it was granted within 30 days of receiving the assistance or until a new application is submitted, if this is submitted before the expiry of this time limit. (Article 34(2) of the Social Security Benefits Act (ZSVarPre); Official Gazette of the Republic of Slovenia, No. 61/2010) The beneficiary is obliged to submit evidence of the use of the funds to the competent social work centre within 45 days after receiving the extraordinary cash social assistance or, at the latest, when submitting a new application for extraordinary cash social assistance if the new application is submitted before the expiry of the time limit referred to in paragraph 2 of this Article. If the beneficiary fails to do so, or if it is established from the evidence that the aid has not been used for the purpose intended or has not been used within the time limit referred to in paragraph 2 of this Article, he/she shall not be entitled to the extraordinary cash social assistance for 14 months after the month of receipt of the extraordinary cash social assistance. (Article 34(4) of the Social Security Benefits Act (ZSVarPre); Official Gazette of the RS, No. 61/2010) If the beneficiary does not use the aid received in full for the purpose for which it was granted, he/she must return the remainder of the funds to the budget of the Republic of Slovenia within 15 days after the expiry of the time limit referred to in paragraph 2 of this Article, otherwise it shall be deemed that the intended use has not been demonstrated. By law, this amount is inviolable and cannot be enforced.
