In the past week, I have seen a controversy about the unconstitutionality of the vignette law, which those responsible know is unconstitutional and still support. Although the proposal has been made several times through this portal, I believe it is necessary to make the proposal again, as it has been rejected in the past by giving incorrect, untrue and misleading answers. The first proposal, entitled "Abolition of vignettes where there were no tolls", was published on this portal on 29.12.2009 by the proposer "aleshorvat". The second proposal, entitled "Vignette for the Ljubljana bypass", was posted on this portal on 11.01.2010 by the user "milan-pss". Both proposals were rejected with the same reply by the then Ministry of Transport, signed by the Acting Director General, Dr Peter Gašperšič (the official letter is attached to both proposals). I am providing a copy of the reply and adding my comments: 1. "According to the provision of Article 11a, paragraph 5, of the Act on Public Roads (Official Journal of the Republic of Slovenia, 33/06 - Official consolidated text, 45/08, 57/08 - ZLDUVCP, 69/08 - ZcestV and 42/09), toll roads for which toll is payable for a fixed period are all motorways and expressways which are managed and maintained by the toll road operator and which are specifically marked for this purpose. With the amendment of two legal acts (Regulation on toll roads and tolls, Toll Road User Charges) adopted last year, freight vehicles also pay tolls on all sections of roads where vignettes are compulsory. Accordingly, freight vehicles are not in a privileged position with respect to passenger cars when paying tolls, as tolls are also charged on bypass roads (expressways), which were non-toll roads before the introduction of vignettes." THE FIRST PART OF THE REPLY IS MISLEADING AND UNTRUE. NPR. According to Article 14 of the Law on Public Roads, expressways are national roads reserved for motor vehicle traffic, which enable long-distance traffic to move quickly between the most important centres of regional importance. This means that roads categorised as expressways are primarily intended to relieve congestion in urban centres in a way that allows long-distance or transit traffic to bypass the towns. Finally, we would like to add that we do not plan to introduce any exemptions from the obligation to pay tolls on motorways and expressways in the future, as the Government's Action Plan foresees the introduction of an electronic toll collection system in the free flow of traffic on both motorways and expressways, for both cars and trucks. GIVEN THAT IT HAS BEEN ALMOST 5 YEARS SINCE THIS REPLY AND THERE IS NO ELECTRONIC TOLL SYSTEM, I FIND IT COMPLETELY IRRESPONSIBLE OF THE GOVERNMENT NOT TO RESOLVE THESE ISSUES AND TO ENSURE THAT DRIVING ON THE LJUBLJANA RING ROAD IS DISCRIMINATORY - FREIGHT VEHICLES DRIVE FOR FREE, CARS HAVE TO PAY A VIGNETTE!!!! IT IS AN UNCONSTITUTIONAL LAW BECAUSE IT ONLY CREATES INEQUALITY AND DISCRIMINATION OF THE INDIVIDUAL BEFORE THE LAW IN THE CASE OF THE USE OF EXPRESSWAYS. On the basis of the foregoing, I propose to the Government: I hope that you as a Government will follow my suggestions. If you do not, you may as well close down your portal, because there is no point in making suggestions if we might find out later that the Government is responding with answers that are untrue, and when it finds out, it will not take appropriate action.
