I propose to add to the Real Estate Transactions Act that the legal transaction for the transfer of title can only be carried out by a professional who is licensed by the State and insured against liability to ensure that the transfer of title will be legally secure and that there will be no need for various lawsuits and court actions in the future, thereby incurring additional costs for buyers and sellers. As already known and stipulated in the Law on Real Estate Brokerage and the Law on the Protection of Buyers of Flats and Single-Family Houses, if the transfer of ownership is carried out by a real estate company with real estate agents licensed by the Ministry of the Interior, the real estate company must ensure that the contract or all documents are drawn up by at least a qualified lawyer with a university degree, whose signature guarantees the legal validity of the contract, which also means that he/she must first double-check the legal obstacles to the conclusion of the transaction. The estate agent also ensures that the buyer has access to all the necessary documents, as well as verifying the identity of the contracting parties. Thus, it cannot happen, or is very difficult, that a property is sold which is not the undisputed property of the seller. However, if this does happen, the liability insurance guarantees the reimbursement of damages to the injured parties. At the same time, this is also a significant amount of VAT payable by the real estate company to the State for each invoice issued in the transfer of ownership. I also propose that the real estate turnover tax be raised to a level of 3.5%, as is the case in neighbouring Austria. The amount of funds thus raised for the state budget on an annual basis can be calculated from the DURS data on the decisions issued for the payment of the real estate turnover tax and the notaries' reports on the notarised sales contracts for real estate for which 8.5% or 20% VAT is payable.
