Dear Sir or Madam, I propose to the Government of the Republic of Slovenia to amend the legislation governing the accountability of civil servants in a way that achieves the objectives and ensures accountability for the objectives that have been set. The proposal is as follows: Every direct and indirect budget user must publish each year the precise objectives that will be set by the head of the budget. Within the targets to be met, it must indicate for each target the person responsible for meeting the target. I propose to publish a traffic light of the objectives and the persons responsible for each specific criterion and objective. After the end of the calendar year, each budget user must enter in the table the percentage of the target achieved. In the event that the target is exceeded by 5%, the manager and the employees are rewarded with 1.5% of their gross salary for the previous year. If the target is exceeded by 10%, the manager and staff shall be rewarded with 3% of their gross salary for the previous year. If the target is exceeded by more than this, it means that either there has been poor planning or that the targets are not demanding enough. In the event that someone has in fact exceeded all expectations, they may be paid up to one year's basic gross salary as decided by the arbitration panel as set out in the proposal. In the event that the target is not met and 97.5% or less is achieved, the manager and employees shall have their gross base salary reduced by 1.25% for a period of one year. In the event that the target is not met at 95%, the manager and employees shall have their gross base salary reduced by 2.5% for a period of one year and all employees within the unit shall be barred from promotion for two calendar years. In the event that the target of 90% is not met, in addition to the above measure, a public report shall be made to the Ministry and the manager shall have his/her gross basic salary reduced by 10% for a period of two calendar years and shall be barred from promotion for the following five years. In the event that the target is not reached at 75%, in addition to the above measure, a public report shall be made and considered by the Government of the Republic of Slovenia and the manager shall lose his/her post due to incompetence, all the employees of the unit shall be assigned in accordance with the Labour Relations Act to another post corresponding to their qualifications and all of them shall have their gross basic salary reduced by 25% and the seniority allowance shall be abolished. A manager who has lost his post may apply for any post in a direct or indirect budget user, but may not occupy any managerial post for the following two years and his new employment in those entities shall be considered as a new employment and shall not be entitled to the seniority allowance. In all the above cases, persons who disagree with the measure may appeal to the competent authority. The appeal is decided by an arbitration panel composed of a representative of the employer, a representative of the government and two representatives of the economy. The business representative is appointed by the Chamber of Commerce and Industry of Slovenia. The representative may not be a person representing a legal entity that has received more than 0.1% of state aid in the last five years prior to appointment to the arbitration board, and the person who will decide the arbitration may not be a person who has paid less than €250,000.00 in income tax, social security and disability contributions in the last five years for a period of five years. The purpose of the proposed measures is to implement the proposed objectives, to hold persons accountable and to ensure that the most capable persons are in positions that are essential for the State.
