Dear Sir or Madam, As it is currently (un)regulated, it would be practically better if there were no regulation at all and that riding motocross bikes in the countryside was simply legalised! This kind of problem has become effectively unsustainable and unmanageable. I am from Gorenjska. Practically every day, either personally or in the media, I see or hear about motocross bikes "crashing" in the fields, in the forests of Jelovica, Pokljuka, Mežaklje, and in the forests of Jelovica. The tracks and the damage are clearly visible. The natural damage is enormous, not to mention the damage to animals. Is anyone chasing them? It is practically not worth going a kilometre to issue a fine of €20 to policemen, inspectors, orderlies, because the offender can only laugh at such a shameful fine (if he can be caught at all). In fact, foreigners (organised by locals) already come to Pokljuka, Mežakla, and Jelovica for motocross rides in the natural environment, because they know that nobody will prosecute them, and if they are caught, the fine is less than the price of petrol for one ride! Riding a motocross bike in a natural environment --> 40 € (half 20 €) Riding a motorbike in a natural environment --> 100 € (half 50 €) I propose to make riding motorbikes (especially motocross) in the natural environment under the Nature Conservation Act (NCA) much more stringent (raise fines) in a way that the fines will achieve their purpose. It is necessary to provide for a mandatory measure of seizure of the unregistered motor vehicle with which the offence is committed. It is also nonsensical to equate driving, parking and stopping with an offence. No one is going to cause as much damage by parking as someone can cause by driving a motocross in the open countryside. So driving in a natural environment should be a stand-alone offence and with a significantly higher starting fine range. For motorcycling, the initial fine should be at least €1 000 and for organising at least €10 000, with compulsory seizure of the vehicle if it is an unregistered motor vehicle. If the MOC is to achieve its purpose and protect our natural environment, the whole system of fines needs to be re-evaluated and the shameful anomalies removed. This, after all, shows our shameful attitude to nature! Just compare how the Building Act protects space (Art. 98): Individual for unauthorised construction - €1000 to €3000 Legal person for unauthorised construction - 10.000€ to 30.000€ I suggest that the ZON also protects the natural environment following the same example (amount of fine).
